People often ask, “Can you use medical marijuana on probation in Georgia?” The answer is sometimes, but a medical marijuana card does not automatically override your probation conditions. Georgia expanded its medical cannabis program in 2026, but probationers must still follow the conditions set by the court and their probation officer.

Medical marijuana use can be legal under Georgia law and still violate probation if the order prohibits marijuana or requires abstinence. What Georgia’s 2026 medical marijuana law allows

The Putting Georgia’s Patients First Act, Senate Bill 220, expanded Georgia’s medical cannabis program on July 1, 2026. Registered medical marijuana patients with an active card may possess approved products containing a cumulative total of up to 12,000 milligrams of THC. Those products must come through the state-regulated system, including a licensed dispensary.

The Georgia Department of Public Health manages the Medical Cannabis Patient Registry. Georgia does not formally call it a compassionate use registry, and DPH does not use “valid patients” as a legal category. What matters is physician certification and an active medical marijuana card.

A Georgia doctor must certify a qualifying medical condition. Qualifying conditions include lupus, inflammatory bowel disease, PTSD under stated criteria, intractable pain, and other medical conditions. Georgia law uses “intractable pain,” not chronic pain. Patients with other medical conditions still need a Georgia doctor to confirm that a qualifying condition applies.

A medical marijuana card is not the same as a valid prescription. A physician certifies the patient for the registry rather than writing a conventional marijuana prescription. If your probation terms mention a valid prescription, ask whether that covers medical marijuana.

What legal rights do medical marijuana patients on probation have?

Georgia Code § 16-12-231 protects registered patients from arrest, prosecution, and certain penalties for authorized medical use.

Georgia Code § 42-8-35 separately allows judges to set probation conditions, including drug testing and treatment. The 2026 law does not say a medical marijuana card cancels a conflicting court condition.

For patients on probation, the written order controls. Probationers should not assume that medical authorization changes those terms. A probation officer supervises compliance, but only the court can change a court-imposed condition. If the order prohibits marijuana, bars illegal drug use, or is unclear about medical marijuana on probation, ask your attorney whether the judge needs to issue a ruling. Judges may interpret conditions differently, so probationers need specific advice. If you use medical marijuana after being told it is prohibited, you risk violating supervision.

Do not use first and argue later. A valid medical marijuana card may help, but violating a supervision term can still lead to a probation violation. Violating a clearly prohibited drug condition may also violate probation. Communicate openly with your attorney and keep proper documentation of medical card status, medical needs, and physician certification.

Can medical marijuana use cause failed drug tests?

Yes. Medical marijuana containing THC can cause a positive drug test. A drug test detects THC or its metabolites. It does not distinguish medical purposes from recreational use.

A positive result does not automatically prove a violation, but it can trigger a probation violation review. Failed drug tests may lead to more testing, a probation officer report, treatment, or an alleged violation.

Do not skip, dilute, substitute, or tamper with a drug test. If marijuana remains detectable, trying to defeat testing can create a separate compliance problem.

What if medical marijuana conflicts with court-ordered treatment?

A treatment program may have its own rules about cannabis, medications, and testing even when medical marijuana is authorized under state law. That can complicate medical marijuana treatment when someone is also receiving other medical treatment.

Tell the treatment provider about your medical marijuana card, doctor certification, and probation terms before treatment begins. That helps the clinical team understand your medical needs and prevent confusion.

What about federal probation, supervised release, and parole?

Georgia medical marijuana law does not change federal law. Federal probation and supervised release may include controlled-substance restrictions, testing, and treatment.

On federal probation, do not treat a Georgia card as permission to use medical marijuana. Speak with the attorney handling the federal case first.

Parole also has separate rules. Review your parole conditions, ask whether the parole officer needs documentation, and get legal advice before using marijuana while on parole.
